  • Your order is an offer to purchase. We may accept or decline your order at our discretion, including for suspected fraud, pricing/stock errors, or other reasons.

  • If your order is canceled after you have been charged, we will issue a prompt credit to your original payment method.

5) Payments, Taxes & Billing

  • By placing an order, you authorize us (and our payment processor) to charge the payment method you provide for the total amount, including applicable taxes, shipping, and fees.

  • You agree to provide current, complete, and accurate billing and shipping information.

  • Prices are shown in the currency indicated on the site; applicable taxes are calculated at checkout based on your delivery address.

6) Shipping, Title & Risk of Loss

  • Processing times are listed on the product or checkout page; shipping estimates are provided at checkout and are not guarantees.

  • Title and risk of loss pass to you upon our delivery of items to the carrier. Please ensure your shipping address is correct before submitting your order.

7) Made-to-Order, Returns & Exchanges

  • Many items are made to order. As a result, we generally do not accept returns or exchanges for sizing or preference once production begins.

  • We stand behind quality. If an item arrives damaged or with a visible print/quality issue, contact us within 30 days of delivery at dyvyneelegance@gmail.com with your order number and clear photos (flat, well-lit surface, tag visible). Once validated, we will replace or refund at our discretion.

8) Promotions, Gift Cards & Store Credit

  • Promotions and discount codes are subject to separate terms, are limited-time, and may not be combined unless expressly stated.

  • Gift cards and store credit are not reloadable, not redeemable for cash (except where required by law), and are subject to the terms presented at issuance.

9) Pre-Orders & Backorders

  • Estimated delivery windows for pre-orders/backorders are projections and may change. You may cancel a pre-order for a full refund before the item ships.

10) User Content (Reviews, Tags, Submissions)

If you submit reviews, photos, videos, testimonials, or tag us on social media using our brand identifiers (collectively, “User Content”), you grant Dyvyne Elegance a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from the User Content in any media for marketing, advertising, and operation of the Services. You represent that you own or control all rights in your User Content and that it does not infringe or violate any third-party rights or applicable law.

11) Intellectual Property

Most Dyvyne Elegance items are made to order. When you place an order, you’re agreeing that:

  • You’ve reviewed the product details, size guide, and processing time.

  • Color/finish may vary slightly due to lighting and screens (especially neon and ombré).

  • Minor measurement tolerances are normal in apparel production.

  • We reserve the right to decline or cancel any order (for example, suspected fraud or pricing error). If we cancel, you’ll receive a full refund for any amount charged.

4) Cancellations & changes

Plain English: Need a change? Do it fast—before production starts.
Use the link in your order confirmation or email dyvyneelegance@gmail.com immediately for address edits or cancellations.

  • Before production: We’ll do our best to update or cancel.

  • After production begins: The order is locked. We’ll still support any quality issues on arrival (see Section 7).

5) Pricing, promotions & availability

Plain English: Prices can change; promos have rules.
All prices are in USD unless noted. We may change prices, run promotions, or limit quantities at any time. Promotional codes generally can’t be stacked and won’t apply to past orders or gift cards (unless stated). We try to keep inventory accurate, but limited drops may sell out.

6) Payment & billing

Plain English: Pay securely with the options shown at checkout.
You authorize us (and our payment providers) to charge your selected payment method for your order total, including taxes and shipping. If your payment method fails, we may put the order on hold or cancel it. For security, we may request additional verification.

7) Returns, refunds & our quality promise

Plain English: We replace or refund quality issues; we do not accept general or size-related returns for made-to-order items.
We stand behind our craft. If your order arrives with a print error, visible defect, or damage, email dyvyneelegance@gmail.com within 30 days of delivery and include:

  • Clear photos of the full item laid flat in good lighting

  • Close-ups of the issue and garment tag

Once verified, we’ll replace the item or refund you. Because items are made to order, we do not accept general returns, exchanges, or sizing-related returns.

Refund timelines (if applicable):

  • PayPal: Typically within 24 business hours to your PayPal balance

  • Card: Typically 7–10 business days (bank dependent)

Digital products, donations, tips, and gift cards are final sale.

8) Shipping, risk of loss & international duties

Plain English: We’ll ship with tracking; international customers may pay customs.
Processing time is typically 1–3 business days, then shipping. We’ll email tracking when your order leaves our facility. Risk of loss transfers to you upon our delivery of the package to the carrier.

International orders may incur customs, duties, and taxes charged by your country. These are not included at checkout and are your responsibility. Delivery timelines can vary by region and customs processing.

9) Style, content & reviews you share

Plain English: Share your looks! If you tag or submit content to us, you allow us to repost and feature it.
If you submit, post, or tag content (e.g., reviews, photos, videos, styling tips) to us or our social accounts, you grant Dyvyne Elegance a worldwide, royalty-free license to use, reproduce, modify, publish, display, and share that content in any media for marketing, promotion, and store features, without additional notice or payment to you. You confirm you have rights to the content you share.

10) Intellectual property

Plain English: Our brand and designs belong to us.
All content on the Services—including logos, graphics, designs, text, photos, videos, and the overall look and feel—is owned by or licensed to Dyvyne Elegance and protected by law. You may not copy, sell, distribute, or create derivative works without our prior written permission.

11) Acceptable use

Plain English: Be kind, lawful, and don’t disrupt the vibe.
You agree not to misuse the Services, including by:

  • Violating laws or rights of others

  • Uploading harmful code or scraping the site

  • Interfering with site operations or security

  • Using automated tools without permission

  • Impersonating any person or entity

We may suspend or terminate access for violations.

12) SMS, email & marketing

Plain English: We text and email when you ask us to—unsubscribe anytime.
If you opt in, you agree to receive marketing emails or SMS (e.g., new drops, VIP offers). Message & data rates may apply. You can unsubscribe via the email link or reply STOP to SMS to opt out. Service messages (like order updates) will still be sent.

13) Disclaimers

Plain English: Sometimes things happen—we can’t promise perfection.
The Services and all content are provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent allowed by law. Any reliance on site content is at your own risk.

14) Limitation of liability

Plain English: Our liability is limited.
To the fullest extent permitted by law, Dyvyne Elegance and our officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or any lost profits or revenues, arising from or related to your use of the Services, even if we have been advised of the possibility of such damages. In all cases, our total liability shall not exceed the amount you paid to us for the product or service at issue.

  • We may limit quantities, discontinue products, or change prices at any time.

4) Orders & Acceptance

  • Your order is an offer to purchase. We may accept or decline your order at our discretion, including for suspected fraud, pricing/stock errors, or other reasons.

  • If your order is canceled after you have been charged, we will issue a prompt credit to your original payment method.

5) Payments, Taxes & Billing

  • By placing an order, you authorize us (and our payment processor) to charge the payment method you provide for the total amount, including applicable taxes, shipping, and fees.

  • You agree to provide current, complete, and accurate billing and shipping information.

  • Prices are shown in the currency indicated on the site; applicable taxes are calculated at checkout based on your delivery address.

6) Shipping, Title & Risk of Loss

  • Processing times are listed on the product or checkout page; shipping estimates are provided at checkout and are not guarantees.

  • Title and risk of loss pass to you upon our delivery of items to the carrier. Please ensure your shipping address is correct before submitting your order.

7) Made-to-Order, Returns & Exchanges

  • Many items are made to order. As a result, we generally do not accept returns or exchanges for sizing or preference once production begins.

  • We stand behind quality. If an item arrives damaged or with a visible print/quality issue, contact us within 30 days of delivery at dyvyneelegance@gmail.com with your order number and clear photos (flat, well-lit surface, tag visible). Once validated, we will replace or refund at our discretion.

8) Promotions, Gift Cards & Store Credit

  • Promotions and discount codes are subject to separate terms, are limited-time, and may not be combined unless expressly stated.

  • Gift cards and store credit are not reloadable, not redeemable for cash (except where required by law), and are subject to the terms presented at issuance.

9) Pre-Orders & Backorders

  • Estimated delivery windows for pre-orders/backorders are projections and may change. You may cancel a pre-order for a full refund before the item ships.

10) User Content (Reviews, Tags, Submissions)

If you submit reviews, photos, videos, testimonials, or tag us on social media using our brand identifiers (collectively, “User Content”), you grant Dyvyne Elegance a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from the User Content in any media for marketing, advertising, and operation of the Services. You represent that you own or control all rights in your User Content and that it does not infringe or violate any third-party rights or applicable law.

11) Intellectual Property

All content on the Services—including designs, graphics, logos, product images, photographs, videos, text, and the selection and arrangement thereof—is owned by or licensed to Dyvyne Elegance and protected by law. TO THE FULLEST EXTENT PERMITTED BY LAW, DYVYNE ELEGANCE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

17) Indemnification

You agree to defend, indemnify, and hold harmless Dyvyne Elegance and our directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your User Content, or your violation of these Terms or applicable law.

18) Force Majeure

We will not be liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, labor disputes, disruptions of internet or telecommunications, or transportation delays.

19) Governing Law; Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Cook County, Illinois for any dispute arising from or relating to the Services or these Terms.

20) Changes to the Services or Terms

We may update the Services and these Terms from time to time. Changes are effective upon posting with the “Last Updated” date above. Your continued use of the Services signifies acceptance.

21) Severability; Assignment; Entire Agreement; Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remainder will remain in full force and effect. You may not assign or transfer these Terms without our consent; we may assign our rights and obligations at any time. These Terms, together with any policies or terms referenced herein (including the Privacy Policy and Returns & FAQ), constitute the entire agreement between you and Dyvyne Elegance regarding the Services. Our failure to enforce any right or provision is not a waiver of such right or provision.
